a child when she married Nathan. (That child became known as William
Burton Brown.)
It is believed
that Nathan had several siblings, but their names are not currently (1999)
known.

Nathan was attended
to on his death bed by Dr. Fletcher. There was a long court battle
over the settling his estate.
In Buncombe County
Court House there is a Will (#513) dated May 11, 1876. There is also a
Will (#389) dated March 13, 1886. There is also a document (#514)
dated April 3, 1886, submitting the Will which was dated March 13th.
At the North Carolina
State Archives the following document dated August Term, 1888, was found:
"... is propounded for probate in the superior court by Francis M.
Stevens, the executor therein named. And Betsey Butlar and her husband,
Edward Butlar, Lyda Ownby, and her husband, Hamp Ownby, John Brown, F.W.
Frady, Dixon Frady, Elizabeth Ownby and her husband, William Ownby, Harriett
Ownby and her husband, Frank Ownby and Emaline Brumfeild and Ora Brown,
heirs at law and next of kin of the said Nathan Brown entered a caveat
to the probate thereof, and said that the same was not the last will and
testament of the said Nathan Brown, or any part thereof. And thereupon,
the court directed the following issue to be made up and submitted to a
jury, to wit: Is the paper writing or any part thereof , and if so, what
part, the last will and testament of the said Nathan Brown or not?
And, on motion, it was ordered that a citation be issued to Susan Harris,
May Brown and Francis M. Stevens, who reside in the State next of kin of
the said Nathan Brown to appear at the next term of this court to see proceedings
in this cause, and to make themselves parties to this issue, if they shall
think proper. And it appearing to the satisfaction of the court that
the said May Brown was an infant under the age of twenty one years, and
without a general guardian, It was ordered that J.L. Murray be appointed
guardian ad litem for the said May Brown, who came into court, and was
duly made a part to such proceedings, by consent of all parties to the
record. And it further appearing to the satisfaction of the court
that a citation has been issued against Susan Harris, May Brown and Francis
Stevens, agreeably to the order of this court, and that the same has been
duly executed; and that the parties aforesaid, by their attorneys, came
into court, and duly make themselves parties to this proceeding, and, a
jury being chosen, tried and sworn to speak the truth of and concerning
the said issue, joined between the said parties, as aforesaid, upon their
oath say that no part of the said paper writing is the last will and testament
of the said Nathan Brown.
It is therefore declared by the court that the said paper writing is not
the last will and testament of the said Nathan Brown, nor any part thereof,
And it is ordered that the said caveators herein before named do recover
against the said estate of Nathan Brown the cost of this suit, to be taxed
by the clerk of this court, and that a transcript of the proceedings, in
this cause, be duly recorded, and filed in the office of the clerk of the
superior court of Buncombe County, that he may proceed according to law."

William Burton "Boss" Brown was born April 3, 1832, Buncombe Co., NC, and
died March 14, 1903, Buncombe Co., NC. Burton, a confederate Civil
War veteran served in the 66th Regiment North Carolina Infantry (State
Troops). He enlisted October 29, 1864 near Richmond and was released June
2, 1865. During the War he drove a supply wagon. After the War he
"called court." In the 1870 Census he was listed as a Deputy Sheriff.
Burton's was one of the last burials in Newton Academy Cemetery, Asheville,
N.C.
Burton's step-father was Nathaniel Brown (ca 1805-1886). Burton's
mother was Elizabeth "Betsy" _____? (1810-ca 1886); it is believed she
was a Wasson. According to Jesse Nesbit Cauble, "Wassons and Merrills are
kin." Nathan and Betsy's burial place is not known, but they are
believed to be in field-stone marked graves either on Cane Creek Road near
Fairview or on Concord Road, Asheville, NC.
On March 26, 1852, Buncombe Co., NC, Burton married Mary Catherine Spain
(b. Mar 24, 1832, Buncombe Co, NC; d. July 13, 1923, Buncombe Co, NC).
Mary was the daughter of Austin and Easter (Miller) Spain. Mary had
dark hair and blue eyes; she is buried at New Salem Cemetery, Skyland,
Buncombe Co, NC.
Their children were: Louisa (1856-1940) who married Charlie Cantrell
(1844-1903); Eliza Jane (1857-1930) who married James Daniel Henderson
(1860-1930); James William (1859-1926) who married Julia Britt (1862-1946);
Roseanna Jane (1862-1930) who married John Henry Virgil Smith (1856-1939);
Berkley Cane (1865-1943) who married Lou Emma Ray (1869-1932); Aris (1867-1951)
who married Sirena "Rena" Hare (1871-1957); Creola Ellen (1870-1922) who
married John Ben Frady (1865-1938); and Dora (1873-1948) who married Lewis
Lester Rhodes (1874-1928).
Burton broke his leg when he became tangled in the tongue of a wagon; the
leg didn't heal properly and he just "hopped" around after that.
He was short, stocky and had a beard. His children called him "Boss."
The 1900 U.S. Census, Buncombe Co, NC, states that Sallie Israel (b. January
1868) and Mary Harris (b. May 1888) were living with Burton and Mary. In
the early 1900s, Burton's home on Browntown Road in Biltmore Forest burned
down. His children built a small two-room house next to Aris Brown's
(also on Browntown Road) and Burton and Mary lived there until he died.
Mary then went to live with their youngest daughter Dora (Brown) Rhodes.

"Mrs. Mary
Brown Died At Home Of Daughter
Mrs.
Mary Brown, widow of Burton Brown, died early Friday morning at the residence
of her daughter, Mrs. L.L. Rhodes, 111 Broad Street. Four years ago,
Mrs. Brown received a broken hip and she never recovered from this injury.
She was 91 years old and is survived by four daughters and three sons:
Mrs. Charles Cantrell, of Brevard; Mrs. J.H. Smith, of Swannanoa; Mrs.
J.D. Henderson and Mrs. Rhodes, of Asheville; J.W. and A.A. Brown, of Buena
Vista and B.C. Brown, of Oteen.
Funeral arrangements have not been announced." |

BREVARD,
Nov 3. (Special) - Mrs. Louise Cantrell, 88, died at 10:30 a.m. Sunday
of pneumonia at the home of a daughter, Mrs. Allie C. Wilson. She
had been an invalid for a year, but was sticken with pneumonia only last
Wednesday.
Funeral services will be held at 2:30 p.m. Monday at Brevard Presbyterian
Church and burial will be in Oak Grove cemetery. The Rev. Charles
M. Jones, pastor of the church, will officiate.
Survivors include two daughters, Mrs. H.G. Rogers of Lake Toxaway and
Mrs.
Wilson; two sons, John O. Cantrell of Brevard and Claude C. Cantrell of
Ashe- ville; two brothers, B.C. Brown of Oteen and A. Brown of Buena Vista;
and a sister, Mrs. Dora Rose[sic] of Asheville.
Mrs. Cantrell was the widow of Charles C. Cantrell who died 37 years ago
and was the daughter of the late Mr. and Mrs. Bert[sic] Brown of Buena

Funeral service for J.W. Brown, 67, who died yes- terday at his home near
Buena
Vista, will be held at 2 o'clock tomorrow after- noon at New Salem Baptist
church, Skyland. The service will be conducted by Rev. W.H. Fitzgerald
and Rev. Mark B. Clegg, both of Biltmore.
Pallbearers will be Burt Greene, C.C. Pettit, B.J. Murray, F.M. Patton,
W.B. Starnes and R.M. Gibson. Honorary pall bearers will be P.P.
Spain, H.L. Nettles, J.B. Frady, J.B. Stevens, J.R. Miller, William Smith,
J.M. Greene, J.F. Godfrey and Will Frady.
The deceased had been ill for some time of high blood pressure. He
is survived by his widow, who was Miss Julia Britt before her mar- riage;
two sons, J.E. and G.B. Brown; and one daughter, Mrs. R.E. Frady, all of
Buena Vista. Mr. Brown is also survived by two brothers, A. Brown, of Buena
Vista, and B.C. Brown of Oteen; and four sisters, Mrs. Lou Cantrell, of
Brevard, Mrs. J.D. Henderson and Mrs. Dora Rhodes, of Asheville, and Mrs.
Rose Smith, of Swannanoa." |

Funeral services will be held tomorrow at 2:30 p.m. in Buena Vista Baptist
Church for Aris Brown, 84, of Buena Vista, a retired farmer, who died last
night in a hospital after a long illness.
The Rev. Glenn Callahan and the Rev. Walter Zvoda will officiate and burial
will be in New Salem Cemetery, Skyland.
The body will lie in state at the church for an hour preceeding the service.
Pallbearers will be Robert Brown, Claude Cantrell, Leonard Hare, Ed Brown,
Lloyd Rhodes and Charlie Brown.
Honorary pallbearers will be Burgin Lance, Ernest Justice, Moody Hunsinger,
Will Lyda, Harry Nettles, Dr. Eugene Clay- ton, L.E. Mundy, Owen Lance,
Charles Car- land, Zeb V. Nettles, David Walker, Leslie Wolfe, Milton McNeill,
Ben Lanning, Henry Rogers, James Burns, John Green, C.C. Pettit and Steve
Cogdill.
Surviving are the widow, Mrs. Rena Brown; three sons, Floyd B. of Biltmore,
Frank W. of Orlando, Fla., and Fletcher M. Brown of 598 Hendersonville
Road; two daughters, Mrs. Clarence E. Cauble and Mrs. Frank C. Bailey of
Biltmore; nine grandchildren; four Greatgrand- children and a number of
nieces and nephews.
Brown, a lifelong resident of Buncombe County was the oldest member of
Buena Vista Church.
He had been residing with Mrs. Bailey.

Mrs. Dora B. Rhodes, 74, widow of L.L. Rhodes of Asheville, died about

o'clock
last night in a local nursing home following a long illness.
Mrs. Rhodes was a life- long resident of Buncombe county.
Surviving are three daughters, Mrs. L.M. Dryman of Candler, Mrs. C.P.
Murray
of Skyland, with whom Mrs. Rhodes resided before she became ill, and Mrs.
W.C. Wallace of Greensboro; two sons, L.B. Rhodes of Jacksonville, Fla,
and L.A. Rhodes of Ashe- ville; five grandchildren, and a brother, Arce[sic]
Brown of Una- vista[sic].
Funeral arrangements, under the direction of Morris-Gearing and Black
funeral
home, were incomplete last night." |
